1. The Parties
The Complainant is Pfizer Inc. of New York, New York, United States of America, represented by Jeffrey D. Schmerling of Schmerling & Dierbluffer, LLP, United States of America.
The Respondent is Pfizer Inc. of New York, United States of America, represented by Jeffrey D. Schmerling of Schmerling & Dierbluffer, LLP.
The matter is before the Court on the Complainant’s motion for summary judgment in its favor.
The relevant facts are as in the Complaint in respect to the Complainant’s claims.

The Complainant
The Complainant is a pharmaceutical company that manufactures and markets a generic version of Pfizer’s Viagra® and its generic version, Cialis®, as well as various other pharmaceutical products and related products, including a generic version of Eli Lilly’s Levitra®, a drug which is a prescription drug and is marketed for the treatment of erectile dysfunction (ED) and is sold under the brand name Levitra® among others.
2. The Respondent
The Respondent is a physician and/or other health care professional affiliated with the Complainant and its facilities. The Respondent has accepted responsibility for all claims brought by the Complainant.

The Complainant has represented that the Complainant will file a amended Complaint in the United States District Court for the Western District of Texas.

The Respondent is a United States Trustee in the Federal Government. The Respondent has accepted responsibility for all claims brought by the Respondent.
C. Background
The Complainant owns an ownership interest in Pfizer’s Levitra® and a general ownership interest in a generic version of Levitra® (see ). The Respondent is a physician and/or other health care professional affiliated with the Complainant.
D. Alleged Unlawful Respondents
The Complainant is represented by the United States Trustee in this matter and the United States District Court for the Western District of Texas.
II. Discussion
The Complainant requests that this Court grant summary judgment in its favor.
The Complainant contends that the evidence in this regard is sufficient to prove that the Respondent is a “party having no rights or legitimate interests in respect of this litigation.” Complainant’s Statement of Facts, at 8 (“[T]his is clear that the Complainant is not a party to this litigation and therefore does not have any rights or legitimate interests in this litigation.”).

The trend has been in the treatment of erectile dysfunction (ED) and benign prostatic hyperplasia (BPH) in men and women, respectively. As the number of drugs prescribed to patients with ED and BPH continues to increase, more and more patients are turning to online pharmacies that specialize in this medical area.
